New Jersey regulators seek input on data center power rules; responses due November 13

Utility regulators asked how to set the size threshold, grid connection priority, emergency curtailment and 10-year payment guarantees that will govern electric service to large data centers under a July law.

New Jersey has begun deciding which data centers fall under new electric service rules and on what terms utilities will serve them. On October 19, 2026, staff of the New Jersey Board of Public Utilities (the “Board”) issued a Request for Information (“RFI”), In re Implementation of the Data Center Fair Share Act, Docket No. EO26080463, to implement P.L. 2026, c. 32 (the “Act”), N.J.S.A. 48:7-6.2. Responses are due by 5:00 p.m. on November 13, 2026, and a virtual stakeholder meeting is set for November 4, 2026.

P.L. 2026, c. 32, § 1 (N.J.S.A. 48:7-6.2); In re Implementation of the Data Center Fair Share Act, Docket No. EO26080463 (N.J. Bd. of Pub. Utils. Staff Oct. 19, 2026) (request for information)
