New York City bulletins cap lifetime yard and height additions to existing buildings

Bulletins effective October 13, 2026, explain when mostly residential buildings may grow into yards or upward despite zoning limits, and count each such addition against a lifetime cap for each yard or roof area.

Owners planning to add rooms, a floor or an accessory apartment to an older New York City house or apartment building now have the Department of Buildings' reading of how far they may build into yards and upward, and of a cap that counts each such addition over the building's life. On October 13, 2026, the Department issued Buildings Bulletin 2026-017, which explains the "Residential Retrofits" provision of N.Y.C. Zoning Res. § 54-53, and Buildings Bulletin 2026-018, which explains the limit in § 54-50 on combining allowances. Both state that they are "effective immediately." A third bulletin issued the same day, 2026-016, addresses § 54-52.

N.Y.C. Dep't of Bldgs., Buildings Bulletin 2026-017 (Oct. 13, 2026); N.Y.C. Dep't of Bldgs., Buildings Bulletin 2026-018 (Oct. 13, 2026); N.Y.C. Zoning Res. §§ 54-50 to 54-53
