New York City sets rules for faster housing rezonings and appeals of Council rejections
City planners adopted procedures, effective November 14, for a 90-day review that ends at the Planning Commission and for a new board that can overturn Council votes on affordable housing.
Housing developers in New York City now have a written rulebook for a shorter rezoning path that ends at the City Planning Commission instead of the City Council, and for an appeal when the Council rejects or cuts back an affordable housing project. The City Planning Commission ("CPC") and the Department of City Planning have adopted rules for the Expedited Land Use Review Procedure ("ELURP") and the Affordable Housing Appeals Board ("AHAB"), adding chapters 14 and 15 to title 62 of the Rules of the City of New York, effective November 14, 2026. The rules implement N.Y.C. Charter §§ 197-e and 197-g, which voters approved on November 4, 2025.
