Pennsylvania requires proof of a water supplier before towns give final approval to development plans

From December 7, subdivision and land development plans served by public or community water need documented supply arrangements before final approval, though proof of adequate capacity is not required.

Developers taking Pennsylvania subdivision and land development plans to final approval will need their public or community water arrangements documented before the municipality can sign off. Governor Josh Shapiro signed Senate Bill 1287 on October 8, 2026, as Act 58 of 2026, according to MyChesCo's report of October 10, amending section 503.1 of the Pennsylvania Municipalities Planning Code (the “MPC”), the statute under which most Pennsylvania municipalities regulate land use. Act of Oct. 8, 2026, P.L. ___, No. 58 (S.B. 1287) (amending 53 Pa. Stat. Ann. § 10503.1). The requirement takes effect on December 7, 2026, 60 days after enactment.
