New York City adopts fast-track land-use review and housing appeals board rules, effective November 14

City Planning rules set eligibility, deadlines and fees for a shorter review of qualifying rezonings and the procedure for a board that can restore housing approvals the City Council rejects or changes.

The New York City Planning Commission (the “Commission”) and the Department of City Planning (“DCP”) have adopted rules implementing two procedures created by the City Charter amendments approved on November 4, 2025: the Expedited Land Use Review Procedure (“ELURP”) under Charter § 197-e and the Affordable Housing Appeals Board (“AHAB”) under Charter § 197-g. The rules add new Chapters 14 and 15 to Title 62 of the Rules of the City of New York (“RCNY”) and amend Subchapter B of 62 RCNY Chapter 3 and 62 RCNY § 10-01. The City’s rules site lists the rules as adopted and effective November 14, 2026; the Commission had listed the vote for its October 5, 2026 review session. The proposal was published in the City Record on July 20, 2026 and heard on September 9, 2026.

62 RCNY Chapters 14 and 15 (new); 62 RCNY Chapter 3, Subchapter B, and § 10-01 (amended); NYC Charter §§ 197-e, 197-g
