Pennsylvania court reopens whether Philadelphia's Council can appeal zoning approvals for affordable housing
The Commonwealth Court will rehear, the week of October 13, its ruling that a councilmember lacked standing to challenge variances for a Strawberry Mansion senior housing building.
Developers of contested housing projects in Philadelphia face renewed uncertainty over whether City Council can take a zoning approval to court through one of its members. On August 26, 2026, the Commonwealth Court of Pennsylvania, the intermediate appeals court that hears zoning appeals, granted reargument of Young v. City of Philadelphia, No. 360 C.D. 2026 (Pa. Commw. Ct. July 13, 2026), in which it had held that Councilmember Jeffery Young, Jr. lacked standing to appeal variances for a 21-unit senior building in Strawberry Mansion, and listed the case for argument the week of October 13, 2026.
