New York City issues preliminary guidance on exempting housing rezonings from environmental review
A qualifying housing rezoning in New York City can now enter public land use review without an environmental assessment, while reviews of rezonings that do not qualify are now subject to statutory deadlines.
On July 10, 2026, the New York City Department of City Planning ("DCP") issued "Qualified Action Guidance – Housing Actions," its preliminary direction on applying the exemption from the State Environmental Quality Review Act ("SEQRA") and City Environmental Quality Review ("CEQR") created by Part R of the State's fiscal year 2027 budget legislation (S.9008-C/A.10008-C, Chapter 58 of the Laws of 2026), now codified at Environmental Conservation Law ("ECL") § 8-0111(5-a). The guidance confirms that "a zoning map change to enable greater residential density" can be a "Qualified Action." A qualifying private rezoning can therefore be certified into public review without the environmental assessment or environmental impact statement ("EIS") that has ordinarily set its schedule.
