New York City makes its anti-harassment permit check permanent and widens the buildings it covers

A law enacted September 12 keeps the no-harassment certificate required before demolition and major alteration permits past its 2026 sunset, with a new building list due by April 15, 2027.

Buyers and owners planning gut renovations, conversions or demolitions of distressed New York City apartment buildings will keep facing a tenant-harassment review before the city issues construction permits, now with no end date. The City Council passed Int. No. 839-A on August 13, 2026, and the Council's legislative record lists it as enacted on September 12, 2026, as N.Y.C. Local Law No. 138 (2026), without the Mayor's signature. It amends N.Y.C. Admin. Code § 27-2093.1 and §§ 28-505.1 to 28-505.4 to make the Certification of No Harassment (“CONH”) program permanent.
