New York proposes requiring active landfills to treat leachate before disposal, with phase-in to four years

DEC's proposed amendments to its solid waste rules would require treatment of leachate at 32 active landfills before it goes to wastewater plants or other discharge, with plans due one and two years after the effective date. Comments closed September 9, 2026. The proposal is not in force.

On July 1, 2026, the New York State Department of Environmental Conservation ("DEC") published a Notice of Proposed Rule Making to revise 6 NYCRR Part 360 and Part 363 so that leachate from currently active municipal solid waste landfills and currently active construction and demolition debris landfills would have to be treated before it is sent to water resource recovery facilities or other discharge locations. The proposal is not in force. Written comments were due by September 9, 2026, after virtual hearings on September 2, 2026, and DEC has not adopted a final rule as of the sources read.
