New York defers greenhouse gas reporting enforcement dates after May climate-law amendments
DEC will not enforce several 2026 and 2027 reporting dates in its mandatory emissions rule while it develops amendments to that rule. The state's climate act was amended on May 26, 2026; published summaries report that the deadline for implementing regulations moved to December 31, 2028.
In a letter dated July 31, 2026, the New York State Department of Environmental Conservation ("DEC") exercised enforcement discretion under 6 NYCRR Part 253, the state's Mandatory Greenhouse Gas Reporting Program, in recognition of its decision to develop a regulatory package amending Part 253 in response to the May 26, 2026 legislative changes to the Climate Leadership and Community Protection Act ("CLCPA"). The letter moves several reporting, verification and plan-submission dates for enforcement purposes. The letter states that entities must still ultimately comply with Part 253, and the Part 253 text itself is not changed by the letter.
