New Jersey ends site plan and variance review for electric vehicle chargers at existing buildings
A law approved September 28, 2026 makes approval of EV charging equipment at existing service stations, retail sites and buildings a non-discretionary permit, limits local review to specific safety impacts, and reaches pending applications. It took effect immediately; the chapter text could not be read.
P.L. 2026, c. 94 (S3739), approved September 28, 2026, removes site plan or other land use board review and variance relief from approvals for electric vehicle supply equipment installed at existing gasoline service stations, retail establishments and other existing buildings. Approval is to be a "non-discretionary permit" issued by the municipality's administrative officer, which the latest text, as summarized on a legislative tracking site, describes as a ministerial act on verification of compliance with applicable standards. The act takes effect immediately and applies to applications pending or submitted on or after enactment.
