New Jersey will require property sellers to disclose dams before buyers sign contracts

A law approved August 6, 2026, adds dam questions to the seller disclosure form; it applies to sales from the 90th day after the state publishes the revised form.

Buyers of New Jersey land with a pond, lake or impoundment will get a written answer from the seller on whether a dam sits on the property and what a new owner takes on with it. Assembly Bill No. 4007 was approved on August 6, 2026, as P.L. 2026, c. 69. It supplements the Consumer Fraud Act, N.J. Stat. Ann. §§ 56:8-1 et seq., and requires sellers to disclose dams on the property condition disclosure statement, the seller form whose contents are set by regulation under N.J. Stat. Ann. § 56:8-19.1. The act took effect immediately but applies only to sales and exchanges on or after the 90th day after the Division of Consumer Affairs publishes the revised form.
